Terms of Service.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Click ("Platform", "Service", "we", "us", "our"), an AI-powered ad creative platform operated by Click Creative AI ("Company"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Description of Service

Click is a SaaS platform that enables users to generate AI-powered ad creatives, analyze brand identities, create moodboards, and manage visual marketing campaigns. The Service leverages artificial intelligence models to produce images, text, and design suggestions based on user inputs and brand data.

3. Account Registration

To access the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Credits and Payments

4.1 Credit System

The Service operates on a credit-based system. Each action (image generation, editing, brand analysis) consumes credits as described in your subscription plan. Credit costs and usage details are displayed within the platform before each action. Unused credits do not roll over between billing cycles unless otherwise specified in your plan.

4.2 Subscription Plans

We offer multiple subscription tiers, including a free tier and several paid plans. Current plan names, features, and pricing are displayed on our pricing page. We reserve the right to modify pricing or plan structures with 30 days' advance notice to active subscribers.

4.3 Payment Processing

Payments are processed securely through our third-party payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by applicable law or as described in Section 4.4.

4.4 Refunds

If you are unsatisfied with the Service, you may request a refund by contacting us at click.imageai@gmail.com. Refund requests are evaluated on a case-by-case basis and are subject to our discretion. We may consider factors such as time since purchase and usage of allocated credits.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable law
  • Generate content that is harmful, threatening, abusive, defamatory, or obscene
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Resell, sublicense, or redistribute access without written authorization
  • Upload content that infringes on third-party intellectual property rights
  • Attempt to generate content depicting real individuals without their consent

6. Intellectual Property

6.1 Your Content

You retain ownership of all content you upload (brand assets, product images, logos). By uploading, you grant us a limited, non-exclusive license to process it solely to provide the Service.

6.2 Generated Content

Subject to your active subscription, you receive a non-exclusive, worldwide, royalty-free license to use AI-generated outputs for commercial and personal purposes. Due to the nature of AI generation, similar or identical outputs may be generated for other users independently.

6.3 Platform IP

All rights in the Service (software, algorithms, design, trademarks) remain the exclusive property of Click Creative AI.

7. AI Disclaimer

The Service uses third-party AI models to generate creative content. You acknowledge that:

  • AI-generated outputs may not always be accurate, appropriate, or error-free
  • You are solely responsible for reviewing and approving all generated content before publication or commercial use
  • We do not guarantee that generated content will not resemble existing copyrighted material or infringe third-party rights
  • AI models may produce unexpected results, and we continuously work to improve quality and safety

8. Data and Privacy

Your data is governed by our Privacy Policy. We are committed to complying with GDPR, CCPA, and other applicable data protection regulations.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLICK CREATIVE AI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Termination

You may terminate your account at any time through your account settings. We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to access the Service ceases immediately. Your data will be handled in accordance with our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or through the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the Republic of Italy, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Milan, Italy.
